General Terms And Conditions
These General Terms and Conditions of accommodation booking at Hotel Miramar (hereinafter referred to as: the Hotel) and payment (hereinafter referred to as: General Terms and Conditions) form an integral part of the accommodation service agreement concluded with Hotel Miramar d.o.o. by booking accommodation at Hotel Miramar in Opatija, Republic of Croatia, and are fully accepted by the guest upon making the reservation.
ACCOMMODATION BOOKING
Accommodation at the Hotel can be booked via our website www.hotel-miramar.info, by telephone, email, or in person at the hotel reception.
ACCOMMODATION CLASSIFICATION
The accommodation units offered are described according to the official categorization of the relevant institution. Standards of accommodation, food, and other services may vary between locations and countries and are not directly comparable. Hotel Miramar d.o.o. does not take responsibility for any verbal or written information that is not consistent with the accommodation description published by Hotel Miramar d.o.o. Furthermore, the Hotel is not liable for any inaccurate information provided by third parties.
RESERVATION GUARANTEE CONDITIONS
When making a reservation through our website, the guest guarantees the booking either by providing a valid credit card or by paying a deposit to the account of Hotel Miramar d.o.o. in the amount equivalent to rate sales policy.
Guest and credit card data are fully protected. Data transfer is carried out through a secure server.
The hotel reserves the right to modify prices on a daily basis. Changes to reservations made directly with the Hotel can only be made in written form via email communication.
If the offer stipulates that a credit card is required as a guarantee, payment will be made according to the valid price list in euros at the hotel reception no later than at check-out, except in the event of no-show or cancellation within the cancellation period when cancellation fees apply. In such cases, the credit card will be used as the payment method for the cancellation charges.
If payment is made in a foreign currency, the conversion into euros is carried out according to the middle exchange rate of the Croatian National Bank on the day of payment processing.
When permitted by the offer, payment at the hotel can be made in cash or by Visa, Maestro, or Mastercard credit/debit cards. If the offer defines that a credit card is required for payment purposes, the full amount of all reserved services will be charged within the period defined by the offer. If payment is made in a foreign currency, conversion into euros will be carried out at the Croatian National Bank’s middle exchange rate on the day of payment.
Credit card authorization and payment are processed via the WebPay service for real-time card authorization and transaction execution.
The protection of personal data is ensured in accordance with the General Data Protection Regulation (EU Regulation No. 2016/679) of the European Parliament and Council, and its implementation provisions.
Monri WSPay, as the processor responsible for executing credit card authorization and payments, handles personal data as a data processor, acting in compliance with the General Data Protection Regulation (EU Regulation No. 2016/679) and the strict rules of the PCI DSS Level 1 standard for the protection of data entry and transmission.
Monri WSPay uses a 256-bit SSL certificate and the TLS 1.2 cryptographic protocol, providing the highest levels of protection during data entry and transmission.
Personal data used for the purposes of authorization and payment, or for fulfilling contractual obligations, are considered confidential information.
Monri WSPay does not process or use personal data for any purpose other than the execution of the authorization and payment contract.
Monri WSPay guarantees compliance with all applicable data protection laws for data processors, in particular by implementing all necessary technical, organizational, and security measures, as additionally confirmed by their PCI DSS Level 1 certification.
RESERVATION CANCELLATION
A guest's reservation becomes valid from the date the hotel receives valid credit/debit card details if such information is required for guarantee, or from the date the card is charged if advance payment is required to confirm the reservation, as stated in the offer. The reservation is held until 24:00 (midnight) on the day of arrival.
Cancellations must be made in writing via email within the time frame defined in the offer. Hotel Miramar d.o.o. reserves the right to retain the amount defined in the offer to cover reservation costs in the event of late cancellation or no-show.
TYPES OF RATES
When making a reservation, the guest can choose from all valid and published rates. Prices depend on the type of accommodation unit, the date of stay, the length of stay, the number of guests, the payment and cancellation conditions, and any additional services.
In addition to the standard service of overnight stay with breakfast and dinner, the hotel also offers special packages according to a specific promotional price list. Special offers cannot be combined with other promotional campaigns, special conditions for Miramar Club members, or other discounts.
SERVICE PRICE
The applicable service price is stated in the offer received via email. Contracted services cannot be combined with other promotional offers or packages, unless otherwise agreed. In case of any changes or deviations from the reserved services, regular prices will be charged. No refunds are possible for unused services. All types of special services not included in the price must be paid by the guest and should be ordered at the time of reservation or requested on site. We reserve the right to refuse, cancel, or modify a reservation if the booking system has been abused or if the reservation was made due to an obvious user error.
ARRIVAL / DEPARTURE
Accommodation is available to the guest from 2:00 PM on the day of arrival. Guests must check out by 10:30 AM on the day of departure, unless a late check-out has been agreed upon. A surcharge of 50% of the overnight price for the requested date applies for late check-out.
TOURIST TAX
Tourist tax is not included in the accommodation price.
The tourist tax amounts to:
EUR 2.00 per person per day from April 1st to September 30th, and EUR 1.50 per person per day for the rest of the year. Children up to 12 years are exempt from paying tourist tax, while children from 12 to 18 years pay 50% of the tourist tax. Taxes are subject to change according to laws and other applicable regulations, and guests agree to bear any potential increase in the tax.
RESERVATION CONFIRMATION AND TRAVEL DOCUMENTS
Guests are required to possess valid personal identification or travel documents. Invalid documents will result in cancellation of accommodation, and if such negligence causes additional damage to Hotel Miramar d.o.o., the guest is obliged to compensate for it. In case of loss, damage, or theft of travel documents during the stay or upon arrival/departure, the cost of issuing new documents is the guest’s responsibility. Hotel Miramar d.o.o. is not responsible for decisions made by customs, police, or other government authorities that deny the guest entry into or exit from the Republic of Croatia.
ACCOMMODATION IN THE HOTEL
The allocation of guests to accommodation units is determined by the Hotel. The guest accepts any officially registered accommodation unit within the reserved accommodation type. The Hotel is unable to confirm the exact accommodation unit number before check-in.
Smoking is prohibited inside the Hotel premises. If it is found that a guest has smoked inside the hotel room, a cleaning fee of 150.00 EUR will be charged.
The additional cleaning fee will also be charged for other inappropriate guest behaviour in the room that causes extra work for the hotel staff beyond the standard room cleaning. In such cases, the fee will be charged per day.
FOREIGN EXCHANGE AND CUSTOMS REGULATIONS
Guests are obliged to comply with applicable foreign exchange and customs regulations, as well as the laws and other subordinate regulations of the Republic of Croatia and other countries they pass through.
COMPLAINTS
Written complaints must be submitted by the guest no later than 3 days after check-out from the Hotel. If the guest submits a written complaint after this period, Hotel Miramar d.o.o. is not obliged to consider such a complaint.
While the complaint procedure is ongoing, the guest irrevocably waives mediation by any other person, arbitration by any other institution, initiating legal proceedings, as well as providing information to the media or posting reviews on online portals.
The compensation amount for a guest complaint may not exceed the value of the disputed portion of the services and cannot include services already used or the entire package price. The guest and Hotel Miramar d.o.o. will strive to resolve disputes amicably; otherwise, they agree that the court with jurisdiction over the seat of Hotel Miramar d.o.o. will be competent. The applicable law is the law of the Republic of Croatia.
It is in the guest's interest to try to resolve all complaints immediately at the Hotel, at the hotel reception. Additionally, the guest can send complaints to [email protected] and will receive confirmation of receipt.
GUEST OBLIGATIONS
The guest is required to comply with the hotel’s house rules. The guest is responsible to Hotel Miramar d.o.o., its guests, employees, and visitors for any damage caused by the guest, especially damage resulting from the breach of the contract and these general terms and conditions. Any damage caused must be settled immediately at the reception upon check-out.
ADDITIONAL SERVICES
Hotel Miramar d.o.o. may offer the guest additional services. Payment for additional services is made according to the contract with Hotel Miramar d.o.o. or the applicable price list. Hotel Miramar d.o.o. does not take responsibility for services provided by third-party providers. If the guest wishes to use additional services, these must be requested in advance at the reception or during the reservation. Additional services include, but are not limited to, the following:
Extra charge for a baby cot: EUR 20.00 per unit per night.
Extra charge for pets: EUR 35.00 per pet per night. Pets are not allowed in restaurants, on terraces, wellness areas, pools, gardens, sunbathing areas, or on the beach.

FINAL PROVISIONS
